Terms of Use

1. Service provider
These Terms of Use ("Terms") govern access to and use of the Bad Habits Buddy mobile application ("App"), published by District Web, SASU, 1056 rue du Bru, 59310 Coutiches, France, legal contact: contact@district-web.fr, registered with the RCS of Douai under number 945 049 112 00010 ("Publisher").
2. Purpose of the app
Bad Habits Buddy is a personal habit tracking app designed to help users reduce or quit recurring bad habits through streak tracking, relapse logging, craving counters, progress history, and premium multi-habit features.
3. Acceptance of the Terms
By downloading, accessing, or using the App, you acknowledge that you have read and accepted these Terms. If you do not agree with them, you must not use the App.
4. Eligibility
You represent that you have the legal capacity to agree to these Terms under the laws applicable in your country of residence. If you are under the age of majority, use of the App should be supervised or authorized by a parent or legal guardian.
5. License
The Publisher grants you a personal, non-exclusive, non-transferable, revocable license to use the App for private, non-commercial purposes, subject to compliance with these Terms.
6. Device and account responsibility
You are responsible for the security of your device, your Apple account, and any access to the App through your environment. You agree to notify the Publisher if you become aware of unauthorized use affecting the App.
7. Free and premium features
Some features are available for free. Premium features, including multi-habit tracking, may be offered through in-app purchases or subscriptions as displayed in the App.
8. Billing, subscriptions, and cancellation
Payments are processed by Apple through the App Store, and subscription status is managed through RevenueCat. Pricing, trial periods, renewals, cancellations, and refunds are governed by Apple's terms. You can manage or cancel subscriptions from your App Store account settings.
9. Prohibited use
You must not, in particular: (i) bypass or interfere with the App's technical protections, (ii) compromise the security or integrity of the service, (iii) use the App for unlawful, fraudulent, or harmful purposes, or (iv) copy, resell, rent, or commercially exploit the App without prior written authorization.
10. Intellectual property
All elements of Bad Habits Buddy, including trademarks, logos, interface design, text, visuals, and code, are protected by applicable intellectual property laws. No ownership rights are transferred to you.
11. Privacy
Information about how data is handled is described in the Privacy Policy available at /privacy.
12. Availability and updates
The Publisher aims to keep the App available, but does not guarantee uninterrupted access. The service may be suspended, limited, or interrupted for maintenance, updates, security reasons, or force majeure, without compensation.
13. No medical or therapeutic advice
Bad Habits Buddy is a self-help tracking tool. It does not provide medical, psychological, therapeutic, addiction treatment, or emergency advice. If you are facing a medical or mental health emergency, contact the appropriate emergency or health services immediately.
14. Disclaimer and limitation of liability
The App is provided "as is" and "as available". To the fullest extent permitted by law, the Publisher disclaims implied warranties and shall not be liable for indirect damages, data loss, business interruption, or intangible harm resulting from use of the App.
15. Termination
You may stop using the App at any time. The Publisher may suspend or terminate access in the event of a breach of these Terms or unlawful use, without prejudice to any available legal remedies.
16. Changes to the Terms
These Terms may be updated at any time. The version published online at the time of consultation is the applicable version. Continued use of the App after an update constitutes acceptance of the revised Terms.
17. Governing law and jurisdiction
These Terms are governed by French law, subject to mandatory consumer protection rules that may apply in your country of residence. Any dispute shall fall under the jurisdiction of the courts of Douai, unless mandatory law provides otherwise.
